I do think the largest problem here with Tekken 6 mod is that people seeing how the modder created new files to attach to Tekken. He didn't alter any Tekken files. It's more akin to adding a function to the game than changing what exists. But it's being viewed as the opposite. But here's the kicker I think that affects culture most: The West (and Japan) has benefitted from stress testing copyright. We have fair-use laws now which allows anyone to put videogame clips on their YouTube for example. That was direct result of someone pushing back on copyright and being sided with in courts. Same with the "right to repair" laws. It was once against the copyright rules to pay someone to open your iPhone and fix a broken battery. That was contested in EU courts and now we are free to fix the things we pay for. Even outright Piracy, which is super illegal has resulted in solutions. Piracy was rife in music and it resulted in iTunes creating a better digital music service for people. Digital movies were pirated like crazy and streaming filled the gap. Same with games and Steam. We have historically seen in the west that copyright and piracy have ultimately led to more "solutions" for the consumer. Japan mostly does not appear to acknowledge or care about this. Which I find interesting, but it's definitely their prerogative. I also think it's that the West considers the "creator to push back on" usually a company. And not "the craftsman" like Japan does.

Stoped reading at point 3. The Japanese are enthusiastically eating up generrative AI even tho it is effectively jut intellectual theft. Their ethos isn't "Meiwaku koi", it's just deference to power and a top down understanding of morality

Okay, that's fair. Take by entire argument and replace "Japan" with: "the few Japanese people I see online discussing this particular subject, that may or may not represent the larger Japanese audience"

Honestly, I think the main thing the West lacks respect for is IP ownership. Bottom line, if you take licensed works into your own hands and do unoffical things with said works, companies involved will be naturally pissed. That's universal and worldwide, BTW.

I strongly disagree with that part about "you should not preserve or extend what does not belong to you", and nothing will change my mind on that one. It feels like it reduces the value of media's artistic and historical value and reduces it to just another disposable product.

Now write a think peace on the western mindset of “entitlement”. And that because they enjoyed something, that enjoyment and that thing is theirs and they are entitled to always have that enjoyment, even if they never did anything to produce the enjoyment to begin with.

"Japan has always been strongly aligned with creator rights." That really gets at the heart of it. People in the West just do not have respect for artists or their creative output; it's just a product to which they are entitled, any time on demand, for free. (Which I very much appreciate as once or twice a year, a Japanese textbook publisher will contact me about reprinting old articles of mine and they always pay a fair fee for the licensing rights)

Personally I think the issue isn't that the West doesn't understand Japan's point of view – it's that Japan doesn't *care* about the West's point of view. They are so culturally tied to their societal norms that they cannot conceive of anyone NOT following them.

One thing I may add is that Japan is really into time exclusive stuff. Seasonal items One time events You wanted to play this game but no way to get it anymore? Too bad. You should've played it while it was available.

I appreciate this explanation. You can certainly see these norms / culture differences in action when you look at the broader industry. Just look at Nintendo, or the lack of support for PC ports from various Japanese developers. Not saying it's "wrong" but you can see these differences between the development norms when you look at it from above, so to speak.

the "who takes responsibility" bit is such a neat way to frame it cause it flips the whole western preservation argument on its head. like we see saving games as a public good and they see it as an unpaid liability move. cant even argue cause theyre not wrong either

I think the issue I have is that while some points are fair but are then used "it could damage future projects", this just doesn't happen often or ever. Like OoT has been recompiled for years, the recomp isn't going to hurt the Remake's performance.

“If someone decompiled Bayo 2 and put it out on PC, I think I’d be pretty miffed.” That’s probably because you’re nothing but a bitch. Why do you give a fuck if Nintendo “loses” out on nonexistent sales? Besides, that’s less a theoretical and more of an inevitability with AI so..

Using bayo as an example is a bold choice because why the fuck do I need to buy a second console to play the next 2 games when the first was pc to begin with. You think you would be pissed if you were nintendo, what about the users that played the first game on pc? –

I think it was Harada that mentioned that people do report issues caused by Tekken mods to BNE as bugs. So, I'd imagine they are getting some bug reports due to the T6 mod which would obviously not be welcomed.

i still find it weird that they dont worry about distribution (the root of the problem). if grassroots modders can introduce reasonable wanted functionality (say decent online play) that corpos cant/wont then nothing will change

Your last point confuses me. What the hell is the point of preserving without distribution? A game that is preserved but cannot be played is functionally the same as one that was never preserved. The point of preservation is so people can continue to enjoy something

IMO it's all about a time limit. After some time it's all fair game. 20 years is more than enough in my view. We can argue where that line is but it has to be somewhere, creator rights forever makes no sense.

but then you don't get the narcissism of getting the credit That's why they release things knowing that they're going to get nailed by lawyers in hours, because they know that none of these companies will actually do anything to them
